TEMPORARY LAYOFFS NOT AT UCSF

 
CUE and UC have come to an agreement over the closures or temporary layoffs. There will be no temporary layoffs at the UCSF campus. Other campuses will be affected.

Excluded from these measures are Medical Center employees and those fully-funded by contracts and grants. It is applicable to CX bargaining unit employees at other campuses (San Diego, Davis, etc.) who are subject to temporary layoffs because CUE and UC were unable to agree on their Salary Reduction/Furlough plan.

UC-CUE Agreement on Temporary Layoffs and Campus Closures

On December 4, 2009, UC and the Coalition of University Employees (CUE) reached an agreement on the issues of temporary layoffs and campus closures. CUE has announced this agreement to its members, and employees have started to ask their supervisors about how it impacts them. It is important to note that this agreement only applies at locations where clerical employees are subject to temporary layoffs.

At this time, UCSF has not decided to implement temporary layoffs of clerical bargaining unit employees.

Therefore, the agreement does not currently apply to employees at UCSF, and prior advice regarding allowing clerical bargaining unit employees to work during closure periods remains in effect.

In the event it applies to your department, here are the terms which will involve other campuses:

The University has already issued temporary layoff notices at some locations to save $13 million towards the alleged budget shortfall. These notices will be rescinded, new ones are issued.

You may take layoff days over any campus closures. That is the default situation. Notify your supervisor in writing if you do not want to take layoff days over the campus closure. If you prefer using layoff days during a campus closure, you do not have to do anything.

You may take the accompanying pay cut in monthly increments over a one-year period, the default; you can take a one-time pay cut, possibly entitling you to unemployment benefits; finally, you can take the temporary layoff days during the year, with corresponding pay reductions.

Notify your supervisor in writing if you prefer paying once for the period of your layoff. If you prefer having monthly reductions for a year, you do not need to do anything.

If you do not want to take the layoff days over the closure, you must use either vaction time or comp time to get paid. You may use up to six advance days of vacation. If you plan to take 11 consecutive days of layoff, you may qualify for Unemployment. If you do, apply on the first day of layoff — or even the Saturday prior. There is a 7-day waiting period from the time you apply, so the sooner the better.

None of the deductions will occur until the February 1st pay date

These layoff days will count as paid days for accrual of benefits, sick leave and vacation.

Here is the formula for layoff days for full-time employees.

Part-time employees with 50% or greater appointments will retain their medical benefits.

The University acknowledges that employees with reduced hours will have less time to perform their assigned tasks. This fact must be taken into account for performance-evaluation purposes.

No one will be required to work overtime to perform the work of another laid-off employee.

START Progam
Employees participating in the START program for fiscal 2009-10 are excluded in this agreement. Employees terminating START before the full 12 months who receive temporary layoff notices shall not have their salaries reduced by more than they amount it would have been reduced by this agreement.

Reiterating
If you do not wish to use layoff days during a campus closure,
NOTIFY YOUR SUPERVISOR IN WRITING before December 18th.

If you prefer a one-time reduction to paying over 12 months,
NOTIFY YOUR SUPERVISOR IN WRITING before December 18th.

IMPORTANT
Written [e-mail acceptable] notification must
be submitted before the first campus closure day.

This eleventh-hour agreement concludes weeks of bargaining over the University of California's Furlough proposal and issuance of temporary layoffs.
